In order to qualify for a chapter 13 bankruptcy you have to earn more money than you spend each month. Instead of having their debt eliminated as is done with Chapter 7, Chapter 13 actually provides the opportunity for individuals to reorganize their debt load by creating a workable payment plan. This allows for people to take the time they need, from one to five years, to pay their creditors. It is not always necessary to pay back your creditors 100% of what you owe. Some payment plans require that you only pay back your creditors a fraction of what you owe.
