SSDI Denial and AppealsOnce you have submitted an application for Social Security disability benefits, your application will be reviewed and either approved or denied. Once an initial decision has been made, you will receive a written notice from the Social Security Administration indicating the decision. If your application is approved, your notice will specify the amount of benefits to be awarded and the start date. If your application is denied, you will have 60 days to appeal. Taking the First StepThe first step in the appeals process is to request a reconsideration within 60 days of the initial denial. At the reconsideration, your claim will be reviewed and decided, and a written notice of the decision will be sent to you. It is likely your claim will be denied again since few initial denials are reversed at this stage. If your claim is denied a second time, you may request a hearing within 60 days of the second denial. At this point in your application and appeals process, it is a good idea to work with an experienced appeals attorney. The Next StepsThere are three levels of Social Security disability hearings available following denials of claims at the reconsideration stage. The first hearing is with an administrative law judge (ALJ). Your attorney is able to present your case arguments and evidence and call witnesses. If your claim is denied, your attorney may take your appeal to the appeals council for a panel of lawyers to review the ALJ decision and written arguments. If this proves unsuccessful, your lawyer may file your case in a United States District Court.
